Liability Release and Assumption of Risk Agreement
I, _________________________, hereinafter referred to as the “Participant,” hereby acknowledge and agree to the terms outlined in this Liability Release and Assumption of Risk Agreement (“Agreement”) with Our World Too, hereinafter referred to as the “Company.”
Nature of the Trip:
The Participant acknowledges that they will be participating in a trip organized by the Company. The trip may involve various activities, including but not limited to hiking, sightseeing, transportation, and any other activities specified by the Company.
Assumption of Risk:
The Participant acknowledges that participating in the trip involves inherent risks, including but not limited to the risk of accidents, injuries, illness, and property damage. The Participant understands and voluntarily assumes all such risks associated with the trip.
Release of Liability:
In consideration for being permitted to participate in the trip, the Participant hereby releases and discharges the Company, its officers, directors, employees, agents, representatives, and organizers from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness, including death, sustained during or as a result of the trip.
Cancellation Policy:
The Participant acknowledges and agrees to the following cancellation policy:
- The deposit paid by the Participant upon registration is non-refundable.
- If the Participant cancels the trip at least 30 days before the trip start date, they are entitled to receive a refund of their payment, excluding the non-refundable deposit.
- If the Participant cancels the trip less than 30 days before the trip start date, they are not entitled to any refund of their payment.
Acknowledgement of Terms:
By signing up for the trip and paying the deposit, the Participant acknowledges that they have read, understood, and agreed to all the terms and conditions outlined in this Agreement.
Indemnification:
The Participant agrees to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, representatives, and organizers from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or related to the Participant’s participation in the trip.
Medical Conditions and Insurance:
The Participant represents that they are physically and mentally capable of participating in the trip. The Participant acknowledges that they have provided accurate information regarding their medical conditions, and they have purchased the mandatory travel insurance required for this trip. The Participant agrees to be responsible for any medical or related expenses incurred during the trip.
Emergency Contact Information:
The Participant agrees to provide the Company with emergency contact information, including the name, phone number, and relationship of a person to be contacted in case of an emergency during the trip.
Modification or Termination of the Trip:
The Company reserves the right to modify or terminate the trip in whole or in part due to unforeseen circumstances, including but not limited to weather conditions, natural disasters, or other events beyond the Company’s control. In such cases, the Company shall not be held liable for any expenses, losses, or damages incurred by the Participant.
Severability:
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement:
This Agreement constitutes the entire understanding and agreement between the Participant and the Company and supersedes any prior or contemporaneous agreements, representations, or understandings, whether oral or written.
By signing below, the Participant acknowledges that they have read, understood, and voluntarily agree to be bound by the terms and conditions of this Liability Release and Assumption of Risk Agreement.
